CA AB 1103 COMPLIANCE

California™s Assembly Bill (AB) 1103 Energy Benchmarking and Disclosure Law is now in effect as of January 1, 2014, and affects building owners when their entire building is being offered for sale, lease, finance or refinance.

In November of 2007, California passed Assembly Bill 1103 (AB1103), mandating energy benchmarking and disclosure for non-residential buildings. CA AB1103 requires non-residential building owners to input energy consumption and other building data into the EPA’s ENERGY STAR Portfolio Manager system, which generates an energy efficiency rating for the building of 1 to 100, 100 being the most energy efficient. If a building reaches a score of 75 or higher, owners can have their ENERGY STAR application certified by a licensed professional engineer and can apply for an ENERGY STAR award decal, which certifies that their building is in the top 25% of other similar buildings nationwide in terms of energy efficiency.

The following building types are required to disclose their building energy data:

  • Assembly
  • Business
  • Educational
  • Institutional Assisted Living and Non-ambulatory
  • Mercantile
  • Residential Transient (i.e. Hotel)
  • Storage
  • Utility Parking garage

The following building sizes are required to disclose their building energy data:

  • 10,000 square feet and above On or after January 1, 2014
  • 5,000 square feet and above On or after July 1, 2016

The energy disclosure requirements of CA AB1103 are as follows:

  • A building owner shall disclose the ENERGY STAR Portfolio Manager “Data Verification Checklist” for the building to the prospective buyer or lessee of the entire building no later than 24 hours prior to the execution of the sales or lease contract.
  • A building owner shall disclose the ENERGY STAR Portfolio Manager “Data Verification Checklist” for the building to the prospective lender financing the entire building no later than submittal of the loan application.
  • A building owner shall submit an electronic copy of the “Data Verification Checklist” via email to the California Energy Commission “CEC” at AB1103report@energy.ca.gov
